Intellectual Property

Intellectual property (IP) refers to creations of the mind, such as inventions; literary and artistic works; designs; and symbols, names and images used in commerce.

IP is protected in law by, for example, patents, copywright and trademarks, which enable people to earn recognition or financial benefit from what they invent or create. By striking the right balance between the interests of innovators and the wider public interest, the IP system aims to foster an environment in which creativity and innovation can flourish.

Patent Law: At Eisenhower, we represent inventors and businesses to identify, protect, and enforce their patent rights before the USPTO and Federal courts including the Patent Trial and Appeal Board against infringers. We provide a full service prosecution offering comprising: patentability searches, provisional and nonprovisional utility patent applications, design patent applications, plant patent applications as well as USPTO office action support, petitions, appeals, as well as post-grant proceedings such as covered business method reviews, inter partes reviews, post-grant reviews, reexaminations, reissues, interference proceedings, and derivation proceedings.

Trademark Law: We take pride in working with businesses of all types in identifying, protecting, and enforcing the brands that have been built up over time. Having a full understanding of business law, our trademark attorneys are well equipped to help you navigate the trademark search process, applications, office actions, petitions, appeals and any opposition proceedings including litigation at the Trademark Trial and Appeal Board (TTAB) and federal court.

Copyright Law: Eisenhower works closely with artists to help them protect and enforce their rights in creative works such as music, sculpture, performing arts, visual arts, and written works. Our clients in this space have appreciated the breadth of knowledge our attorneys have when it comes to integrating their copyrights into their business plan. Our copyright attorneys have a sound approach to making sure each step of the way protects the creations that our clients have worked so hard to bring about.

Trade Secret Law: One of the least known areas of Intellectual Property and underutilized, is Trade Secret law. Closely tied with Employment law, Eisenhower attorneys skillfully advise our clients on keeping certain technologies, know-how, manufacturing methods, receipies, and customers lists secret within their organization. Trade secrets gain their value from being secret, so by being careful to assure proper methods of documentation, and measures have been taken is critical to being able to enforce misappropriation (theft of trade secrets) should it ever happen.

Litigation

Eisenhower attorneys pursue cost-effective means of speedy resolution, including informal negotiation, mediation, and arbitration. If litigation proves unavoidable, we have the years of experience to see the case through to resolution. Our attorneys have proudly represented clients in matters in state and federal court and before various state and federal agencies.
